Terms of Service

1. Acceptance of Terms

Dermascript LLC ("Dermascript Pro," "we," "us," or "our") provides a practice management and electronic record-keeping platform (the "Service"). By creating an account, subscribing to a plan, or otherwise accessing the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Nature of the Service — Not a Medical Device

Important: Dermascript Pro is an administrative and documentation tool intended for scheduling, billing, general record-keeping, and practice management purposes only. The Service is not a medical device, is not intended for clinical decision-making, diagnosis, treatment planning, or the recommendation of any specific therapy, and does notanalyze patient data to render or suggest a medical conclusion.

All clinical decisions, diagnoses, and treatment plans are the sole responsibility of the licensed practitioner. The Service does not control medical hardware and does not provide diagnostic or therapeutic advice. Nothing in the Service constitutes medical advice or a substitute for the professional judgment of a qualified healthcare provider.

3. No Medical Advice Disclaimer

The Service, including all content, charts, notes, photographs, and analytics, is provided for administrative convenience only. It is not intended to be relied upon for medical, clinical, or diagnostic purposes. You acknowledge that any reliance on the Service for such purposes is strictly at your own risk and that Dermascript LLC disclaims all liability arising from such use.

4. Your Account & Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to use the Service in compliance with all applicable laws and professional regulations, including those governing patient privacy and the handling of protected health information (PHI).

As the custodian of any patient data you enter, you are responsible for obtaining any consents required to store and process that data, and for configuring role-based access so that only authorized members of your team can view sensitive records.

5. Subscriptions & Billing

Paid plans (Solo and Clinic) are billed on a recurring monthly basis until cancelled. You may cancel at any time; access continues until the end of the current billing period. Fees are non-refundable except where required by law. We may adjust pricing with reasonable advance notice; existing subscribers will be notified before any change takes effect.

6. Security & HIPAA Alignment

The Service is designed with security best practices, including encryption in transit and at rest, role-based access controls, and audit logging. We describe the Service as "HIPAA-ready" and "HIPAA-aligned" to reflect these safeguards. Implementing a full HIPAA compliance program within your practice — including business associate agreements, staff training, and risk assessments — remains your responsibility.

7. Acceptable Use

You agree not to misuse the Service, including by entering data you do not have the right to store, attempting to reverse engineer or disrupt the platform, sharing credentials, or using the Service for any unlawful or unprofessional purpose. We may suspend or terminate accounts that violate these Terms.

8. Intellectual Property

All software, branding, design, and documentation provided by Dermascript Pro are the property of Dermascript LLC and are protected by intellectual property laws. You retain ownership of the patient records and content you create within the Service.

9. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, Dermascript LLC shall not be liable for any indirect, incidental, or consequential damages, or for any loss arising from clinical decisions made in reliance on data stored in or displayed by the Service.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide a prominent notice within the Service. Continued use after changes take effect constitutes acceptance of the revised Terms.
